Terms of Service

Terms governing use of the Moonjourn app and website.

§ 1 Scope and Provider

These Terms of Service govern the use of the mobile application Moonjourn ("App") and the website moonjourn.app, both provided by Sven Kasek, Hohenzollerndamm 8, 10717 Berlin, Germany ("Provider", "we").

Your counterparty is the natural person who creates a profile in the App or uses the website ("you"). By installing the App or creating a profile you accept these Terms.

Conflicting terms are only recognised if expressly confirmed by us in text form.

§ 2 Subject Matter

Moonjourn is a smartphone application offering content on tarot, astrology, moon phases and a personal journal. Content is partly personalized using artificial intelligence (e.g. daily-card interpretations). The App serves self-reflection and entertainment.

The App includes a free basic version and an optional Premium subscription with extended features. Details on Premium are set out in § 4.

§ 3 Conclusion of Contract and Parties

Usage Agreement

The free basic usage agreement is concluded when you create a profile in the App. These Terms govern this usage and license agreement between you and us.

Premium Subscription via App Store and Google Play

Premium subscriptions are concluded exclusively through the Apple App Store (Apple Distribution International Ltd., Ireland) or the Google Play Store (Google Commerce Ltd., Ireland). Apple or Google is the legal seller and payment recipient ("Merchant of Record"). The purchase contract for the subscription is concluded between you and Apple or Google, not directly with us.

Purchase, payment, renewal, cancellation, and refund are governed by the respective terms of Apple (Apple Media Services Terms) or Google (Google Play Terms of Service).

We are the content provider. We make the Premium features available after activation by Apple or Google. This content and license agreement between you and us is governed by these Terms.

§ 4 Premium Subscription: Pricing, Term, Renewal

Prices

  • Monthly subscription: EUR 9.99 per month
  • Annual subscription: EUR 49.99 per year (equals EUR 4.17 per month)
  • Annual subscription optional: 7-day free trial

All prices are final prices including statutory VAT where applicable. Prices are displayed in the Apple App Store or Google Play Store in local currency according to their rules; deviations due to exchange rates and local tax may apply. Billing is handled directly via your Apple or Google account.

Automatic Renewal

Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period in your Apple or Google account settings. You cancel directly with Apple or Google; we have no technical ability to terminate a store-based subscription on your behalf.

Free Trial

During the 7-day free trial you may cancel at any time via your Apple or Google account without cost. Without cancellation the regular paid subscription begins after expiry.

Price Changes

Price changes for active subscriptions are communicated by Apple or Google according to their policies (typically via email and in the store app) and, in certain cases, require your renewed confirmation. We may additionally notify you in-app or by email. Before a new price takes effect you may cancel your subscription via your Apple or Google account.

§ 5 Right of Withdrawal for Consumers

Consumers are natural persons concluding a legal transaction for a purpose that is predominantly outside their trade, business or profession.

Withdrawal Instructions

Right of Withdrawal. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of contract conclusion.

Purchase contract via Apple or Google: Since the purchase contract for your Premium subscription is concluded between you and Apple or Google, the right of withdrawal concerning the payment is directed primarily at these providers. You may request withdrawal via reportaproblem.apple.com or the Google Play refund page.

Content and license agreement with us: In addition, you may withdraw the content and license agreement concluded with us. To exercise this right of withdrawal inform us with a clear statement (e.g. by email to hello@moonjourn.app, Sven Kasek, Hohenzollerndamm 8, 10717 Berlin). You may use the sample withdrawal form below; it is not mandatory. Timely dispatch of the notice preserves the deadline.

Expiry of Withdrawal Right for Digital Content

Important note on in-app purchases: Your right of withdrawal for contracts on the supply of digital content not on a tangible medium (e.g. unlocking of Premium features) expires in accordance with § 356 (5) BGB when the following three conditions are met:

  1. You have expressly consented that we begin performance of the contract before the withdrawal period expires.
  2. You have confirmed awareness that with your consent and the start of performance you lose your right of withdrawal.
  3. We have provided you with confirmation of the concluded agreement (typically via Apple or Google purchase confirmation and in-app notification).

Since Premium features are unlocked immediately upon subscription and during App Store or Google Play Store checkout you expressly consent to immediate performance, the right of withdrawal generally expires at the start of performance. For refunds please contact the respective platform support (Apple or Google).

Consequences of Withdrawal and Refund

Premium subscriptions are processed exclusively through the Apple App Store (Apple Distribution International Ltd.) or the Google Play Store (Google Commerce Ltd.). Apple or Google is the legal seller and payment processor. Payments go directly to Apple or Google, not to us. Direct refunds by us are therefore only possible where we exceptionally received a payment directly from you (e.g. for special services outside the stores).

Refunds for Apple and Google subscriptions must be requested directly from the platform:

  • Apple: reportaproblem.apple.com
  • Google Play: Google Refund Policy

If we have exceptionally received a payment directly from you, in the event of an effective withdrawal we will refund the amount without undue delay and no later than fourteen days after receipt of the withdrawal, using the same means of payment as in the original transaction unless otherwise agreed. On request we will support you with your claim towards Apple or Google.

§ 6 User Obligations

You agree to:

  • provide truthful information during profile creation,
  • not misuse, manipulate or automatically scrape the App or website,
  • not introduce malware or circumvent technical security measures,
  • not commercially exploit or publicly perform App content without our written permission,
  • not use the App for unlawful purposes.

On serious or repeated violations we may suspend your profile or terminate the contract extraordinarily.

§ 7 Content and Liability Notice

Content provided in the App (interpretations, horoscopes, rituals, affirmations, daily cards, soul-type evaluations) serves exclusively entertainment and self-reflection. It does not replace medical, psychotherapeutic, legal, financial or other professional advice.

§ 8 Minimum Age

Use of the App is permitted without parental consent from age 16 (Art. 8 GDPR). Users under 16 may use the App only with consent of a parent or legal guardian. Under COPPA (USA) we do not knowingly process data of children under 13. Under PIPA (Korea) age threshold for non-parental consent is 14.

§ 9 Availability

We strive for high availability but do not guarantee it. Maintenance, technical failures at App Store, Google Play or ISPs and force majeure may cause temporary unavailability.

§ 10 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

For slightly negligent breach of material contractual obligations (cardinal duties) liability is limited in amount to the contract-typical, foreseeable damage. Material contractual obligations are those whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely.

Otherwise liability for slightly negligent breaches of duty is excluded.

§ 11 Privacy

Information about processing of personal data is in our Privacy Policy.

§ 12 Changes to the Terms

We may amend these Terms when legally or technically required or when App features materially evolve. Material changes are communicated at least 30 days before effect in-app or by email. Without objection within 30 days the changes are deemed accepted. We will remind you of this right of objection and its consequences when announcing changes.

§ 13 Final Provisions

German law applies under exclusion of the UN Sales Convention. For consumers mandatory consumer protection provisions of their country of residence remain unaffected.

Should individual provisions be invalid, the validity of the remaining provisions is unaffected. The statutory regulation replaces the invalid provision.
